Terms and
Conditions

1. Acceptance

Acceptance of a quotation, payment of a deposit, or written instruction to proceed confirms that the customer accepts these terms and conditions.

2. Quotations

Quotations are valid for 14 days unless stated otherwise. Prices are based on the information and site conditions available when the quotation is prepared. Any work not specifically included will be treated as additional work.

Obvious errors or omissions may be corrected before work begins.

3. Deposits and staged payments

A deposit may be required to secure the booking and purchase materials. The amount and payment schedule will be stated in the quotation.

Deposits are not automatically refundable where materials have been ordered, time has been reserved or costs have already been incurred. Any amount retained following cancellation will be limited to TJK Carpentry’s reasonable costs and losses.

For larger projects, staged payments may be required as work progresses. Failure to make an agreed payment may result in work being paused until the account is brought up to date.

4. Payment of invoices

Unless otherwise agreed in writing, invoices are payable within 7 calendar days of the invoice date.

Payment must be made by bank transfer using the invoice number or customer name as the payment reference. The customer must raise any genuine invoice query promptly and must not withhold an undisputed payment.

5. Late payment

TJK Carpentry reserves the right to recover reasonable costs incurred in collecting overdue payments.

For business customers, statutory interest and compensation may be charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. Statutory interest is currently calculated at 8% above the Bank of England base rate, together with applicable recovery compensation. GOV.UK guidance

For domestic customers, interest may be claimed where legally recoverable, including through court proceedings where necessary.

6. Additional and unforeseen work

Changes requested by the customer and work made necessary by concealed or unforeseen conditions—including rotten timber, defective walls, hidden pipework, unsafe electrics, asbestos, structural defects or unsuitable existing installations—are not included unless specifically stated.

Additional work will be discussed and, wherever reasonably possible, priced before proceeding. Emergency or minor work required to leave the property safe may be undertaken and charged reasonably.

7. Materials

Materials remain the property of TJK Carpentry until paid for in full, so far as legally possible and while they remain identifiable and removable without causing damage.

Natural timber and similar materials may vary in colour, grain, texture and movement. These natural characteristics are not necessarily defects.

Material prices may change if the customer delays acceptance or the start date. Any increase will be discussed before materials are ordered.

8. Customer-supplied materials

TJK Carpentry is not responsible for the suitability, quality, shortages, defects or delayed delivery of materials or products supplied by the customer.

Additional labour, return visits or alterations caused by incorrect, damaged or unsuitable customer-supplied items may be charged separately. Manufacturer warranties remain the customer’s responsibility unless agreed otherwise.

9. Access and site preparation

The customer must provide reasonable access to the property, a safe working area and access to electricity and water where required.

Unless included in the quotation, the customer is responsible for clearing furniture and personal possessions from the working area. TJK Carpentry is not responsible for delays or additional costs caused by restricted access or an unprepared site.

10. Timescales and delays

Any start or completion date is an estimate unless expressly agreed as a fixed date in writing.

TJK Carpentry is not responsible for reasonable delays caused by matters outside its control, including adverse weather, supplier shortages, late deliveries, illness, hidden defects, other trades or changes requested by the customer. The customer will be informed of significant delays as soon as reasonably possible.

11. Other trades

TJK Carpentry is not responsible for defects, delays or damage caused by the customer, other contractors or work carried out after completion.

Where work depends upon another trade, the programme may be adjusted until the preceding work is safe and ready.

12. Completion and snagging

The customer should inspect the work when reasonably requested and report any concerns promptly. TJK Carpentry must be given a reasonable opportunity to inspect and, where responsible, correct defective work before another contractor is employed.

Nothing within these terms affects the customer’s statutory rights. Services supplied to consumers must be performed with reasonable care and skill under the Consumer Rights Act 2015. Consumer Rights Act 2015

13. Damage and existing defects

Reasonable care will be taken while working at the property. TJK Carpentry is not responsible for pre-existing damage, defective structures, poorly secured items, hidden services that were not identified, or minor decorative disturbance reasonably resulting from the agreed work.

Making good and decorating are excluded unless specifically included in the quotation.

14. Waste removal and cleaning

Waste removal is included only where expressly stated. Otherwise, waste and packaging will be left safely on site for the customer to dispose of.

The working area will be left reasonably clean, but a professional or full-property clean is not included.

15. Cancellation

Cancellation must be provided in writing. The customer will be responsible for work completed, materials ordered, non-refundable supplier charges and other reasonable losses caused by the cancellation.

Where statutory cancellation rights apply, these terms do not restrict them. Certain contracts agreed online, by telephone or at a customer’s home may carry a 14-day cancellation period. If the customer asks for work to begin during that period, written consent should be obtained, and the customer may need to pay for work completed before cancellation. Official Trading Standards guidance

16. Suspension or termination

TJK Carpentry may suspend or terminate work where:

  • An agreed payment is overdue.

  • The site is unsafe.

  • The customer prevents reasonable access.

  • The customer behaves abusively or threateningly.

  • Continuing would breach legal or professional requirements.

The customer remains responsible for work completed, materials ordered and reasonable costs incurred up to that point.

17. Photographs

TJK Carpentry may take photographs to document progress and completed workmanship. Photographs identifying the customer, address or personal information will not be published without permission.

18. Liability

TJK Carpentry does not exclude liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of the customer’s statutory rights.

TJK Carpentry will not be responsible for losses that could not reasonably have been anticipated when the contract was agreed.

19. Complaints

Any complaint should be submitted in writing with photographs where possible. TJK Carpentry will investigate the matter and must be allowed reasonable access and opportunity to put right any work for which it is responsible.

20. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be dealt with by the courts of England and Wales, subject to the customer’s applicable statutory rights.
